Description

From an ethical and professional perspective, holding a disclosure conversation after an adverse event is the right thing to do. Many physicians remain concerned, however, about having their conversations used against them in a malpractice lawsuit. It is common for physicians to wonder:

• What should be disclosed?
• How do I say it?
• Who should be involved in the conversation?
• Should I document the conversation?

This seminar is designed to assist you in answering those questions.

Objectives

Participation in this seminar will better enable participants to:

• Develop a common-sense approach for an effective disclosure process;
• Examine the role of the physician before, during, and after an unanticipated outcome; and
• Establish and implement risk mitigation techniques that may enhance communication, impact patient safety, and decrease liability.

Target Audience

Physicians of all specialties; no experiential or academic prerequisites are necessary.

Accreditation

This activity has been planned and implemented in accordance with the accreditation requirements and policies of the Accreditation Council for Continuing Medical Education (ACCME) through the joint providership of NORCAL Insurance Company and ProAssurance Indemnity. The NORCAL Insurance Company is accredited by the ACCME to provide continuing medical education for physicians.

Faculty

Stephen R. Shows, J.D., is a Senior Risk Resource Advisor for ProAssurance, providing risk management advice to physicians and other healthcare providers regarding medical malpractice issues. Mr. Shows is a licensed attorney who practiced for many years in litigation, always for the defense. He also served as an Assistant Attorney General for the State of Alabama. He holds a B.S. degree in Molecular Biology from Auburn University and a Juris Doctorate from the Cumberland School of Law at Samford University. He is a member of the Defense Research Institute and the Birmingham Bar Association.

Tina Reynolds J.D., is a Senior Risk Resource Advisor for ProAssurance. She worked for many years as a hospital Certified Nurse Case Manager at facilities in New Hampshire, Massachusetts, Washington, and Alaska. Her clinical background also includes Home Health Care and Physician Practice. She has experience in Facility Credentialing for Harvard Pilgrim Health Care and as a Care Coordinator for Private Healthcare Systems. She obtained her law degree from the Massachusetts School of Law, obtaining CALI Awards for Medical Malpractice and Health Care Law. She is a member of the Massachusetts Bar Association. She is also a Certified Professional in Healthcare Risk Management, and Certified Case Manager.
